Don't Worry, Howard Stern's Still Making a Ludicrous Amount of Money

• Howard Stern has signed a five year deal to keep his show on Sirius Radio. No exact monetary figure yet, but his last deal was $100 million a year, and he called this deal "very fair," so it has to be in the same ballpark. The good thing is it keeps Howard Stern fans all in one easily identifiable media ghetto.

• The New York Times has quietly eliminated its useless (we say that with no prejudice) "Social Media Editor" position. Jennifer Preston, who held it, is returning to reporting. The paper will reportedly "shift social media responsibilities to Aron Pilhofer‘s interactive news team." Ah well. Ok Go Explains There Are Lots Of Ways To Make Money If You Can Get Fans

Over the last few years, we've covered many of the moves by the band Ok Go -- to build up a fanbase often with the help of amazingly viral videos, ditch their major record label (EMI), and explore new business model opportunities. In the last few days, two different members of Ok Go explained a bit more of the band's thinking in two separate places, and both are worth reading. First up, we have Tim Nordwind, who did an interview with Hypebot, where he explained the band's general view on file sharing:

Obviously we'd love for anyone who has our music to buy a copy. But again, we're realistic enough to know that most music can be found online for free. And trying to block people's access to it isn't good for bands or music. If music is going to be free, then musicians will simply have to find alternative methods to make a living in the music business. People are spending money on music, but it's on the technology to play it. They spend hundreds of dollars on Ipods, but then fill it with 80 gigs of free music. That's ok, but it's just a different world now, and bands must learn to adjust.

Elsewhere in the interview, he talks about the importance of making fans happy and how the band realizes that there are lots of different ways to make money, rather than just selling music directly:

Our videos have opened up many more opportunities for us to make the things we want to make, and to chase our best and wildest ideas. Yes, we need to figure out how to make a living in a world where people don't buy music anymore. But really, we've been doing that for the last ten years. Things like licensing, touring, merch, and also now making videos through corporate sponsorship have all allowed us to keep the lights on and continue making music.

Separately, last Friday, Damian Kulash wrote a nice writeup in the Wall Street Journal all about how bands can, should and will make money going forward. In many ways the piece reminds me a bit of my future of music business models post from earlier this year -- and Kulash even uses many of the same examples in his article (Corey Smith, Amanda Palmer, Josh Freese, etc.). It's a really worthwhile read as well. He starts by pointing out that for a little over half a century, the record labels had the world convinced that the "music" industry really was just the "recorded music" industry:

For a decade, analysts have been hyperventilating about the demise of the music industry. But music isn't going away. We're just moving out of the brief period--a flash in history's pan--when an artist could expect to make a living selling records alone. Music is as old as humanity itself, and just as difficult to define. It's an ephemeral, temporal and subjective experience.



For several decades, though, from about World War II until sometime in the last 10 years, the recording industry managed to successfully and profitably pin it down to a stable, if circular, definition: Music was recordings of music. Records not only made it possible for musicians to connect with listeners anywhere, at any time, but offered a discrete package for commoditization. It was the perfect bottling of lightning: A powerful experience could be packaged in plastic and then bought and sold like any other commercial product.

But, he notes, that time is now gone, thanks in large part to the internet. But that doesn't mean the music business is in trouble. Just the business of selling recorded music. But there's lots of things musicians can sell. He highlights Corey Smith and Smith's ability to make millions by giving away his music for free, and then touring. But he also points out that touring isn't for everyone. He covers how corporate licensing has become a bigger and bigger opportunity for bands that are getting popular. While he doesn't highlight the specific economics of it, what he's really talking about is that if your band is big, you can sell your fan's attention -- which is something Ok Go has done successfully by getting corporate sponsorship of their videos. As he notes, the sponsors provide more money than the record labels with many fewer strings:

These days, money coming from a record label often comes with more embedded creative restrictions than the marketing dollars of other industries. A record label typically measures success in number of records sold. Outside sponsors, by contrast, tend to take a broader view of success. The measuring stick could be mentions in the press, traffic to a website, email addresses collected or views of online videos. Artists have meaningful, direct, and emotional access to our fans, and at a time when capturing the public's attention is increasingly difficult for the army of competing marketers, that access is a big asset.

Now when we need funding for a large project, we look for a sponsor. A couple weeks ago, my band held an eight-mile musical street parade through Los Angeles, courtesy of Range Rover. They brought no cars, signage or branding; they just asked that we credit them in the documentation of it. A few weeks earlier, we released a music video made in partnership with Samsung, and in February, one was underwritten by State Farm.



We had complete creative control in the productions. At the end of each clip we thanked the company involved, and genuinely, because we truly are thankful. We got the money we needed to make what we want, our fans enjoyed our videos for free, and our corporate Medicis got what their marketing departments were after: millions of eyes and goodwill from our fans. While most bands struggle to wrestle modest video budgets from labels that see videos as loss leaders, ours wind up making us a profit.

Of course, that only works if you have a big enough fanbase, but that doesn't mean there aren't things that less well known bands can use to make money as well. He talks about an up-and-coming band in LA that doesn't even have a manager that was able make money:

The unsigned and unmanaged Los Angeles band Killola toured last summer and offered deluxe USB packages that included full albums, live recordings and access to two future private online concerts for $40 per piece. Killola grossed $18,000 and wound up in the black for their tour. Mr. Donnelly says, "I can't imagine they'll be ordering their yacht anytime soon, but traditionally bands at that point in their careers aren't even breaking even on tour."

The point, Kulash, notes, is that there's a lot of things a band can sell, focusing on "selling themselves." And, the thing he doesn't mention is that, when you're focusing on selling the overall experience that is "you" as a musician or a band, it's something that can't be freely copied. People can copy the music all they want, but they can't copy you. "You" are a scarce good that can't be "pirated." That's exactly what more and more musicians are figuring out these days, and it's helping to make many more artists profitable. And, no, it doesn't mean that any artist can make money. But it certainly looks like any artist that understands this can do a hell of a lot better than they would have otherwise, if they just relied on the old way of making money in the music business.

WALL STREET: MONEY NEVER SLEEPS

Wall Street: Money Never Sleeps is a movie with big ideas on its mind, but it only knows how to communicate them in crayon. It’s a seriously stupid film that seems to have gotten a half-hearted pass from critics simply for being timely. I hesitate to even call it a sequel to Wall Street, since it’s relevant to that film in theme only; Gordon Gekko barely factors into the narrative, and on the rare occasion that he does, it only further exposes how dramatically inert the whole thing is. The rest of the runtime is spent on characters blathering buzzwords and financial jargon in an attempt to push an agenda so thoughtlessly constructed that it necessitates what’s essentially a big budget PowerPoint presentation in order to drive it home. Oh and hey look at that, here’s Susan Sarandon in a five minute role as Shia LaBeouf’s real estate agent mom. See, now we’re dealing with the housing market! God we’re topical!

Twice within four days, my name has popped up in the Bush-era secret cables uncovered by WikiLeaks. Lucky me. Though nowhere near as earth-shattering as the uncovering of American misdeeds in Iraq and Afghanistan, these classified cables provide a stunning and bizarre peek into the paranoid minds of the Bush White House when it came to the subject of one Michael Francis Moore.

And considering how WikiLeaks has released only 1,826 cables of its planned drop of 251,287 -- and I've already played a starring role twice -- I can only say I await with bemused anticipation how the moi-storyline will play itself out.

The most recent secret cable revelation is in today's Guardian newspaper of London. It's entitled, "US Intervened in Michael Moore NZ Screening." Oh yeah, baby! New Zealand! That's where we'll stop Moore and his band of evildoers!

The date was July 30, 2004. Fahrenheit 9/11 was already a huge hit in the United States. Just to give you an idea how huge, it had hit #1 at the box office, the only documentary to have ever accomplished this feat, and had made more on its opening weekend than Star Wars: Return of the Jedi.

But it was no easy path to get there. Disney (which owned Miramax) was apoplectic when they saw the final cut. So they pulled the film from its theatrical schedule. Then they put a permanent block on its release, ensuring no one would see it. But then the New York Times, in a front page story, reported that the real reason Disney hated Fahrenheit was they were worried about the tax breaks it got in Jeb Bush's Florida for Disney World. This caused some embarrassment, so Disney then sold Fahrenheit to the Weinstein Bros., who said they'd spend their own money to distribute it.

The release of the film caused concern at the White House, as this was the reelection year. They hired a pollster who told them the film might tip the election. That was enough for them to swing into action. Much of July was a nonstop barrage of attacks on me and the movie. But that just resulted in more tickets being sold.

Which brings us to Wellington, the capital of New Zealand. There are few nations on earth further away from us. A local chapter of the ruling Labor Party apparently had decided to do a fundraising screening of Fahrenheit 9/11. It was to be hosted by the Prime Minister's Cabinet Secretary for the Environment.

Well, when the U.S. Embassy in Wellington got word of this, it was like all heck broke loose. America was offended! Phone calls were made to the Prime Minister! Then to the Cabinet Secretary! We... are... not... happy!

Apparently, the Kiwis backed down and the Cabinet Secretary withdrew as the host. A sigh of relief whiffed its way through the American embassy. Moore stopped! The cable back to Washington showed the embassy had no problem taking credit for putting the kabosh on yours truly:

... it is probable that this potential fiasco may only have been averted because of our phone calls -- it is apparent to us that neither the Minister nor anyone else in the Labour government seems to have thought there was anything wrong with a senior Minister hosting such an event.

So here's my question:

Really?

I mean, seriously -- really? This is how the Bush State Department was spending its time -- on a single screening of Fahrenheit 9/11 in freakin' New Zealand? Or maybe... was this kind of interference happening just to New Zealand? Call me crazy, but I gotta feelin' it doesn't stop there. Just as a health insurance executive has now come forward as a whistleblower to reveal the millions spent to smear Sicko, I can't help bt wait for the day when the whistleblower from the Bush White House comes forward to tell the fascinating tale of how the Bush team believed they had to do something -- anything -- to stop Fahrenheit. Or worse (like the "Plan B" the health insurance companies discussed -- to "push Michael Moore off a cliff."). I didn't want to think about what the Bush Plan B would be. Just wasn't worth the crazy-making. So I ignored the things I'd hear, kept my head down and motored on.

But, it does make you wonder. And I ask you, is it fair to pose the question: If they were this focused on some insignificant screening in New Zealand, what else were they up to? And I don't mean in regards to me. I mean anyone who was on their enemies list...

I can't wait to read more classified cables.

Last April, when Elizabeth Warren was still chairing the Congressional Oversight Panel on the Troubled Asset Relief Program, the Treasury Department's Home Affordable Modification Program got its third failing grade because its "response continues to lag well behind the pace of the crisis" and not reaching "the overwhelming majority of homeowners in trouble.” The panel gave HAMP another bad grade on Tuesday. In fact, the overall view was even more critical than eight months ago. The panel:

...found that in the eight months since the Panel's last report on the Home Affordable Modification Program (HAMP), Treasury has made minor tweaks to the program, but the changes have not resolved the Panel's core concerns. The Panel now estimates that, if current trends hold, HAMP will prevent only 700,000 foreclosures -- far fewer than the three to four million foreclosures that Treasury initially aimed to stop, and vastly fewer than the eight to 13 million foreclosures expected by 2012.

It is too late for Treasury to revamp its foreclosure prevention strategy, but Treasury can still take steps to wring every possible benefit from its programs. Treasury should enable borrowers to apply for loan modifications more easily -- for example, by allowing online applications. Treasury should also carefully monitor and, where appropriate, intervene in cases in which borrowers are falling behind on their HAMP-modified mortgages. Preventing redefaults is an extremely powerful way of magnifying HAMP's impact, as each redefault prevented translates directly into a borrower keeping his home. ...

“any billions of dollars set aside for foreclosure mitigation may well be left unused. As a result, an untold number of borrowers may go without help—all because Treasury failed to acknowledge HAMP’s shortcomings in time.” ...

“Despite repeated urgings from the panel, Treasury has failed to collect and analyze data that would explain HAMP’s shortcomings, and it does not even have a way to collect data for many of HAMP’s add-on programs. Further, Treasury has refused to specify meaningful goals by which to measure HAMP’s progress, while the program’s sole initial goal—to prevent 3-4 million foreclosures—has been repeatedly redefined and watered down.”

As with the past four reports on HAMP's progress, the Treasury - represented this time by Timothy Massad, acting assistant director for financial stability - called the criticisms too harsh:

“One can criticize it, but you have to compare it to the alternatives. That’s where there’s not really any consensus,” he added.

Massad noted that of the five panel members unanimously backing the report, three believe HAMP should go further and two think the private sector can handle foreclosure aversion on its own.

The situation for both home-owners who owe more on their mortgages than their homes are worth and the overall economy is not good. While the number of "underwater" mortgages fell in the third quarter - from 11.3 million to 10.8 million - does not reflect an improvement in the housing market. It's because banks got more aggressive about foreclosures. And the recent decline in foreclosures comes mostly from a slowdown as a result of the scandal of fraudulent, rubber-stamped documentation:

Underwater borrowers pose a serious risk because they are far more likely to default if they lose their jobs or meet other financial shocks. It is difficult for them to refinance and take advantage of low mortgage rates and they are unable to sell their homes unless they cover the shortfall out of savings or convince the bank to sell at a loss in what is known as a short sale.

"It's a giant anchor that's holding back the economy," said Sam Khater, senior economist at CoreLogic. "Until that negative equity recedes, the housing market is not going to recover. It's as simple as that."

Such mortgages present all kinds of problems. Some borrowers try to sell for whatever they can get, driving down home prices. As prices drop, still more borrowers find themselves underwater. Many out-of-work or financially fragile householders find it difficult to sell their homes without taking larger losses than they can handle, which means they won't or can't move to areas of the country where they might find a job or a better one. Many foreclosed houses stand vacant and that reduces prices even more. The Federal Reserve Bank of New York estimates that 3 million more houses are vacant currently than usual.

All this reduces the turnover of houses, which means less money moves into residential investment, which means there is less home construction - traditionally a sector that helps speed a recessionary economy into recovery. This contributes to anemic job gains and the whole cycle continues. In May, the New York Fed reported that a turnaround could take five years or more.

I generally agree with yoru statement, all the tricks the FED did to print hosuing dollars are done now, now people have to bring real money, and that means wages. However I disagree with statement "businesses competing with foreign wages CANNOT pay higher wages to American workers". Businesses overpay their CEOs and upper management all the time (boards are made up of cronies, not directors working in best interest of stockowners) and big US businesses are generally making high profits and have record cash reserves. So businesses CAN afford to pay workers high wages, but rather, they simply WON'T because they do not have to (no laws, unions etc to force them) and the WON'T because unlike the waste of over-priced salaries at high-end of coroporate ladders, business are not so stupid and wasteful and low-end and they keep low and middle workers wages as low as they can or they outsource.

But just so you know in real world there is an alternative ( not one you will ever see in US due to our politics and people assumptions like yours) look at Germany. They are an exporting machine. Their companies are very competitive in world market AND their worker wages and benefits are much higher than US. They have higher horuly salaries, their workers get 6 weeks vacation from get go, etc.. Also, they are fairly heavily regulated, their companies are held to high safety standards, high worker fairness standards, and tough environmental standards and also their companies do a lot with expensive alternative energy.

So in my mind there are at least two ways to for a countries companies to be competitve on world market, China or Germany, the only option is NOT China and depressed wages and weak currency.

Again and again, I see smart people assuming we must just do a China to compete, low wages, weak currency, trash the environment, peel back regulations that keep workers safe and keep work place fair. Its like Germany's example does not enter our consciousness. No way we can have a strong social safety net, treat enviroment well, have a strong currency, pay workers well, regulate businesses to ensure fairness and still compete, pay not attention to Germany.

It may not be easy for US to replicate what is working for Germany, primarily simply because most in US media and culture has it so we don't even know it that at least one coutnry is already proven it is possible, but it is crazy not to at least look at what they are doing and see if maybe we could strive for something closer to them. Germany competes and grows and German workers benefit. Germans model is very good for the common wealth, and yet, all we can fixate on is China.

We see same phenomen in business. There are some companies that are very successful and treat their workers much better than average, while other companies see their only way to success is to treat low end workers as badly as possible and to overcompensate upper management. See simply Costco vs. Sam's club.

Stop self-limiting, we can be a globally competitive country and have a solid middle class and have clean air and water, safe workplaces. But we won't if we let crony upper management of US companies decide everything in their interest, because clearly, sh%^ting on workers and over-compensating themselves and their friends, corrupting our government for their purposes is what they will keep doing unless we fight for something better.

Making Money Your

Every so often Warren Buffett goes on TV and calls for higher taxes. This from the guy who’s paid, according to Forbes, perhaps less than $10 million in taxes, a tiny percentage of his $50 billion net worth. I say perhaps because, to the best of my knowledge, Buffett has never made his tax returns public.

Buffett is big-business, with his Berkshire Hathaway holding company stock selling (today) at $119,675.00 per share. Berkshire Hathaway has 1 million shares, which means that Buffett heads a company worth more that the gross national product of a few small Latin American countries.

How does Buffett manage to pay so little in taxes? For one, Buffett, who wants everybody to pay for big-spending big government, donates sizable amounts to tax-exempt philanthropies, such as the Gates Foundation. Forbes, again,

He donates appreciated Berkshire Hathaway stock — which costs him pennies on the dollar — to charity, and receives a fat, juicy tax deduction at the appreciated price without having to pay a capital gains tax on the appreciation. (And, note that the money actually sits in his own charitable organization.) He’s saving income taxes with the ordinary deduction so it’s essentially a tax shelter.

He builds up his massive net worth and doesn’t have to sell stock while deferring capital gains. When he does take a capital gain, it’s at a 15% rate, and he lives in a low-tax state.

Buffett has been known to complain that he paid taxes on the lower-rated capital gains rate rather than the higher income-tax rate. Well, play me the world’s smallest violin, Warren.

Mind you, I’m all for capitalism. America is the greatest country in the world because historically it afforded its citizens the ability to legally prosper and live in abundance. What I object to is billionaires who got their own aiming to prevent anyone else from attaining the same, or more, as they.
